What does subsection ( 2 ) of the Copyright Act mean?
(2) Nothing in subsection (1) shall be construed as applying to the assignment of the copyright in a collective work or a licence to publish a work or part of a work as part of a collective work.

(2) Moral rights may not be assigned but may be waived in whole or in part. (3) An assignment of copyright in a work does not by that act alone constitute a waiver of any moral rights.

Thus, the law provides a right to the maker (creator) of the copyright to exchange the ownership of the copyright to a third party. The owner of the copyright in an existing or future work may assign to any person. It can be assigned either wholly or partially and with or without limitation on whole or any part of the copyright.

Assignment of copyright can be done in exiting work at the time of assignment. Section 18 permits assignment by a prospective owner, i.e. a person, who is not the first owner as defined in Section 17 of Copyright Act, 1957, in future work.
